Businessicy – The East Jakarta District Court has decided to proceed with the lawsuit filed by PT Aneka Tambang Tbk (Antam) against Budi Said and associates. This decision comes after the court rejected the objections raised by Budi Said, allowing the legal proceedings to continue with the examination of the core issues of the case.
This decision was announce by the panel of judges led by Wiyono, S.H., along with judges Chitta Cahyaningtyas, S.H., M.H., and Said Husein, S.H., M.H., during a hearing on Tuesday, August 20, 2024. The court affirmed its absolute and relative jurisdiction over the matter.
In this interim ruling, the court instructed both parties to proceed with the legal process and deferred the case costs until a final decision is reached. The court emphasized that this is a civil dispute, not a criminal one, and will continue under the jurisdiction of the East Jakarta District Court.
Antam’s legal representative, Andi F Simangunsong, welcomed the court’s decision and expressed readiness for the upcoming hearings. Andi also expressed hope that the court would grant Antam’s claim, considering the alleged unlawful actions by certain Antam employees that resulted in losses for the company.
“It is appropriate for the East Jakarta District Court to have jurisdiction since this lawsuit is a civil case concerning unlawful acts, not a criminal case. We are prepare to face the upcoming hearings and will prove our claims,” he stated on Tuesday, September 3, 2024.

According to Andi, the transaction involving the sale of gold with Budi Said is considere legally flawed due to the alleged provision of money or goods to certain Antam employees, who seemingly offered discounts on the gold purchases. He assert that such transactions were invalid and should be annulled legally.
Antam filed this lawsuit following a decision by the Supreme Court, which ruled that the company must pay compensation of 1.1 tons of gold to Budi Said. In this counterclaim, Antam is demanding the return of 5.935 kilograms of gold from Budi Said, offering to refund Rp 3.59 trillion in return.
Antam also regards the actions of several other parties, including Eksi Anggraeni, Endang Kumoro, Misdianto, and Ahmad Purwanto, as unlawful for having delivered gold to Budi Said. Therefore, Antam is requesting the return of excess gold received by the defendants.
Additionally, Antam disputes Budi Said’s claim regarding the 1.1 tons of gold he has not received. Based on a certificate issued on November 16, 2018, by Endang Kumoro—who is a defendant in this case—Antam asserts that the document is invalid, void, and lacks legal binding power.
Previously, Budi Said claimed to have paid for 7.07 tons of gold bars from Antam in 2018, but he alleges that he only received 5.9 tons. The remaining 1.1 tons of gold, which he claims was not receive, is the central issue in this dispute.
With the continuation of these legal proceedings, Antam hopes to achieve justice and legal protection concerning the ongoing issue.
